Come see me on a good day. That is not a sentence a d*ad man writes. Storage Unit 108 was eleven miles away, on a road full of tire shops, and the unit was paid up for six years in advance — a fact I would later learn cost my father eleven hundred dollars and which he did, Ruth Adler told me, in cash, on the day after his diagnosis, because “a man who is going to forget things pays ahead.” Inside was a folding chair, a card table, and nine banker’s boxes. Four years of a marine-parts distributor’s books, organized by a man who could no longer reliably remember the word for spatula. And on the table, a cassette recorder. The recording is eleven minutes long. It is my stepbrother Royce, on the shop’s landline, in a conversation with a man about a payment, saying things that make sense only if you have been moving company money for two years. And at minute seven, it is Vonetta’s voice in the background, not on the phone, saying — clearly, close to the receiver, unaware: “Royce, the boy’s going to see it. He is alive, he’s not in pain, and he does not always know what year it is.” I put my head on that woman’s desk and cried for about four minutes, and she let me, and then she gave me a tissue and said: “All right. Now the hard part. Josiah, your father is alive, which means that woman does not own that house.” PART 3 Here is how it worked, and it is not exotic. It is the most ordinary version of this there is. Vonetta had a power of attorney, signed by my father in the first year of his diagnosis, when he was still himself on most days. A power of attorney is not ownership. It is the right to sign as somebody, in their interest. Fourteen months ago she placed him at Halloway — under his own name, legally, correctly, which is the part everybody finds hardest to believe. She did not hide him in an attic. She put him in a licensed facility two counties away, paid by his own long-term care policy, and then she simply did not tell one person on earth where he was. Me. Because I was the only person who would come. And using that same power of attorney, eleven months ago, she signed a deed transferring the house on Ridgemont from Clayton Kemp to Clayton Kemp and Vonetta Kemp as joint owners with right of survivorship. Which means: the day he d*es, it’s hers, outright, with no probate, no will, no notice to anybody. That’s it. That’s the crime, and it happens about four hundred times a year in this state, and almost none of them are ever called anything. “Is that legal?” I asked Ruth. “An agent under a power of attorney cannot make a gift to herself unless the document expressly authorizes it,” she said. “Your father’s document did not. I know because I have the original of the replacement he signed six weeks before your trial, which revokes hers and names you, and which she has never seen because she never asked me for anything.” “She doesn’t know it exists?” “Josiah,” Ruth said, “in forty-one years the single most common feature of these cases is that the person doing it is absolutely certain nobody else is keeping paper.” “Why didn’t you do anything?” It was not a kind question and she took it without flinching. “Because I am not his guardian and I was not his agent — the replacement names you, and you were incarcerated, so it couldn’t operate. I filed a concern with Adult Protective Services in March. They visited. He was clean, fed, appropriately placed, and his wife had lawful authority, so they closed it. That is the correct outcome under the law and it is the wrong outcome, and I have been sitting on this for eleven months waiting for you to walk up those stairs.” Ruth made me do one thing before I went, and I resented it for about four days and have thanked her for it ever since. She made me write out what I was going to say. “Josiah, you have four years of things stored up. You’re going to walk in there with all of it and he has maybe twenty good minutes in him, and you will spend them on you.” “He’s my father.” “He is. And the man in that room is not going to be able to hold ‘I didn’t steal it, Dad.’ He’ll hold that you came. Pick what he can hold.” So I wrote three sentences on the back of a receipt in the parking lot at Halloway and I have them still. “I’m out.” “I’m not angry at you.” “I’ll come Thursdays.” That’s all I brought in. Four years of being called a thief in a courtroom, and I left the whole thing in a truck in a parking lot, because a seventy-four-year-old attorney told me the truth about what a damaged brain can carry. I have thought since that this is the actual difference between people who get these years and people who don’t. Not the lawyers. Not the recording. Somebody who tells you, before you walk in, to leave your case at the door. I saw my father on a Thursday. Halloway Memory Care, room 108 — and I want to note that number, because my father’s storage unit was 108, and Ruth says that is a coincidence, and I have decided not to believe her. He was in a chair by a window. Seventy-one years old, thinner, shaved by somebody else, wearing a cardigan I did not recognize. I stood in the doorway for a long time. Then he looked up. “Well,” my father said. “There he is.” “Dad.” “You’re late,” he said. “I’ve been up since six.” That was a good day. I did not know yet that you cannot order them. We talked for forty minutes about a boat he sold in 1998. At the end he said, “Is your mother coming?” and I said she was at the store, because the nurse had told me that morning: do not correct him about the d*ad, it is cruel and it does not stick. When I stood up to go, he caught my wrist. “Son.” “Yeah, Dad.” “Did you get the key?” For a second the whole room went silent. “I got the key.” He nodded, satisfied, and let go, and then he asked me who I worked for now, and the good day was over. Ruth Adler was furious with me. She was also, she told me later, not entirely sorry, because “Josiah, a judge who has read a file about a woman hiding a man from his son does not mind seeing the son in an orange shirt. It makes her wonder who put him in it.” The hearing was on a Tuesday. The courtroom was full, because Vonetta had brought people — her church circle, two of her friends, her sister — the way a person does when they believe they are attending a formal confirmation of their own good character. I was allowed one personal item. I brought a framed photograph of my father that Ruth had retrieved from storage unit 108, from a box my mother had packed in 2011. I sat at the table and held it against my chest with both arms, because my hands were cuffed in front and there was nowhere else to put it. Ruth put on the case in about fifty minutes. The revoked power of attorney, filed with her office four years ago and notarized six weeks before my trial. The deed, recorded eleven months ago, transferring the house to herself under an authority that did not permit self-gifting. Vonetta went for the aisle — not at me; I want to be accurate, she was going for the door and they were between her and it — and she was shouting, and one deputy got an arm across and the other took her elbow, and she screamed one sentence over the top of all of it, at the back of my head. “He doesn’t even know who you are!” That’s the one. Out of everything — three years inside, the door closing with a soft click, the word bur*ed — that is the sentence I still hear. Because she said it to hurt me, and she said it in front of forty people, and it was, on most days, true. I did not turn around. I sat at that table and held my father’s photograph and looked at the judge, and Judge Vireo looked back at me for what the transcript records as a pause. Then she said: “Mr. Kemp, you may stand for this part if you’d like.” “Your Honor, I’d rather sit.” “Why is that?” “Because if I stand up, ma’am,” I said, “I’ll have to put him down.” PART 5 — FINAL The court revoked Vonetta’s authority, voided the deed, and appointed me as my father’s guardian and conservator. That was the Tuesday. The trespass charge was dropped on the Thursday. The criminal referral took fourteen months. Vonetta pleaded to financial exploitation of a vulnerable adult and got probation, restitution, and a permanent record. Royce pleaded to the original thefts — the ones I did three years for — which is how a thing like this actually ends in this country: not with a trumpet, but with a clerk entering a plea in an empty courtroom on a Wednesday afternoon. I went to see Royce once. County jail, forty minutes, through glass, eleven weeks after his plea. He looked exactly the same, which surprised me more than anything else about that year. “You came to gloat,” he said. “No.” “Then what.” “I want to ask you one question and then I’ll go, and you can answer it or not.” He shrugged. “Three years,” I said. “Not the money. I don’t care about the money. When they read the verdict and my father wasn’t in that courtroom — did you know she’d told him it was a different day?” Because that is the thing I had not been able to put down. My father was not at my trial. For three years I believed he chose not to come. Royce looked at the table for a while. “Yeah,” he said. “She told him it was Thursday. It was Tuesday. He sat in the kitchen in a suit all day.” And that was the whole interview. I said thank you — I actually said thank you, which I have thought about since — and I stood up and I left, and I sat in my truck in a jail parking lot and cried harder than I have ever cried about anything, because for three years the loneliest fact of my life had been a man who didn’t come, and it turned out he had been in a kitchen in a suit. My conviction was vacated in the spring. There is a certificate. It is one page and it uses the word “vacated” and not the word “innocent,” and Ruth warned me about that eleven times before it arrived and I still sat in my car with it for an hour. Some things did not come back. Three years. That’s the number everybody focuses on and it is not the one that matters to me. The one that matters is fourteen months. Fourteen months where my father sat in a chair by a window in room 108 and the sign-in book had one name in it. I have the book pages. Ruth subpoenaed them and I have never been able to throw them away. Some days I do the arithmetic — four hundred and twenty-six days, and on how many of them was he having a good one, and how many of those did I miss — and my therapist has asked me to stop, and I am working on it. Dad lives with me now. That is not a triumphant sentence. It took nine months, a downstairs bathroom I could not afford, and a home health aide named Renata Achebe who is worth more than every lawyer in this story combined. He knows me about half the time. On the other half I’m “the young man who does the yard,” which I have decided to find funny, mostly. There is no version of this where I get him back the way he was. The house on Ridgemont was sold. My decision, and I made it alone, and Ruth told me to take a week and I took six. It paid for the ramp, the bathroom, four years of Renata’s hours, and the difference between a facility bed and a bedroom with his own window. He never asked about it. Not once. Delphine comes on Sundays. She has never once been late, in two years, and she never mentions the sign-in book, and I have never made her. That is our arrangement and it is working. I have the rose bushes back. That’s the part I want to end on, because it is the only thing in this whole story that I did purely because I wanted to. Vonetta ripped them out. They were my mother’s — planted in 1996, four canes, the fussy kind you have to prune at exactly the wrong time of year — and the first thing I did when I got the house keys back, before the sale, before anything, was drive over there and dig up what was left of the root crowns with a shovel out of the garage. Three of the four took. They are in a bed outside my father’s window, and they are not doing especially well, and I have been told by two people at the garden center that I should start over with new stock. Last June, on a good day, Renata wheeled him out to the patio and he sat looking at them for a long time. And my father, who does not reliably know the year, said: “Those are Marilyn’s.” “Yeah, Dad. They are.” “They look terrible.” “I know.” “Well,” he said.
